Terms of Service

These Terms of Service ("Terms") govern your use of services operated by NHM LLC ("NHM," "we," "us"), including the public website at nhmohio.com, the online dashboard and tools, our APIs and backend services (including those delivered via Cloudflare), and the DomainGuard mobile application ("DomainGuard") for iOS. By accessing or using any of these services, you agree to these Terms.

1. Services overview

NHM provides managed IT and cybersecurity services to businesses, primarily in Northeast Ohio. Our digital properties include: informational and marketing pages; free security and IT tools; optional user accounts with a dashboard for domain monitoring, scans, alerts, status monitoring, and related features; programmatic access via API for eligible plans; and DomainGuard, a companion mobile app for account holders. Specific features depend on your plan and product configuration.

2. Mobile applications (DomainGuard)

DomainGuard is provided as a convenience for accessing your NHM account and monitoring data on a mobile device. When you download DomainGuard from the Apple App Store, you also agree to Apple's terms and rules for the App Store. We do not guarantee that every feature available on the website is available in the app, or vice versa; we describe core capabilities in the app listing and in-app screens.

3. Subscriptions, payment, and refunds

Paid plans are sold only as in-app subscriptions in the DomainGuard app, processed by Apple through the App Store. There is no card checkout on this website. Subscriptions renew automatically for the same term until you cancel. Pricing, trial terms, and plan limits may change; we will use reasonable means to communicate material changes, and a change takes effect no earlier than your next renewal.

Cancellation and refunds. You may cancel at any time in your Apple account's subscription settings. Cancelling takes effect at the end of the billing period you have already paid for; access is not withdrawn before that date, and you are not charged again. The complete terms, including what is not refundable, are in our Refund Policy, which forms part of these Terms.

In-app purchases. Payment, renewal, cancellation, and refunds for in-app subscriptions are governed by the platform provider's terms and your account settings with that provider (your Apple Account). We cannot issue a refund for a purchase made through a platform provider. To the extent of any conflict between these Terms and the platform provider's mandatory terms for in-app purchases, the platform terms control for payment and billing disputes solely as required by those platforms.

Nothing in this section limits any statutory right you have as a consumer, including a statutory right of withdrawal or cancellation under the law of your country of residence.

4. Third-party services and integrations

Our services may interoperate with third parties you configure (for example, email providers or third-party status pages). Your use of those services is subject to the third party's terms. We are not responsible for outages or actions of third-party services.

5. Account terms

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials, including any two-factor authentication methods.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 18 years of age to create an account.
• One person or entity may not maintain more than one account.

6. Acceptable use

When using our website and services, you agree not to:

• Use our security scanning tools to scan domains, IP addresses, networks, or systems you do not own or have written authorization to test. Network and IP scanning requires you to affirm, per target, that you own or are authorized to scan it; that affirmation is recorded, and running scans against systems you are not authorized to test is a violation of these terms and may be unlawful
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use our services for any illegal purpose or in violation of any applicable laws
• Interfere with or disrupt the integrity or performance of our services
• Attempt to reverse engineer, decompile, or disassemble any portion of our services
• Use automated tools to scrape, crawl, or extract data from our website beyond what is permitted by our robots.txt
• Send spam, distribute malware, facilitate phishing, test stolen credentials, disrupt a target, or use scan results to attack or exploit any person, domain, service, or network
• Evade or attempt to reset a plan, trial, rate, domain, scan, or usage limit, including by deleting and re-adding domains or monitored addresses, creating additional accounts, rotating API keys or network addresses, or automating repeated requests
• Run scans at an excessive frequency, spread scans across many targets, or otherwise use the service in a way that resembles reconnaissance, denial of service, spam, or malicious automation

We may review unusual activity and contact you for an explanation, proof of authorization, or steps needed to stop it. We may rate limit or block requests, revoke free or promotional access, suspend an account, or permanently ban an account when we believe activity is spammy, malicious, unauthorized, deceptive, or abusive. We do not permit abuse on the Free plan, a trial, a paid plan, or through the API.

7. Free tools and resources

Our free tools (Domain Checkup, IT Checkup, Password Checker, Phishing Quiz, Lookalike Domain Check, and the single-record checkers on our tools page) are provided "as is" for informational and educational purposes only. Results from these tools should not be considered a substitute for professional IT security assessments. We make no guarantees regarding the accuracy, completeness, or timeliness of scan results.

8. Dashboard, API, and enterprise features

The dashboard and related APIs provide domain monitoring, security scanning, compliance tooling, and other features described on our site or in-product. Enterprise or API access may require separate configuration (including API keys). Different tiers offer different limits and functionality. We may modify features, limits, or pricing with reasonable notice where practicable.

Basic scans read only what a site serves to the public. Deep scans (port scans, vulnerability checks and exposed-file probes) run only on a domain the account has verified it controls, by a DNS record, a file, an email link, or a verified sign-in address at that domain, unless we have approved the account for deep scans of any domain. We decide each such request by hand and may refuse or withdraw it.

The Free plan includes bounded manual website, vulnerability, and dark web scans. Active vulnerability checks require current DNS or file proof that you control the monitored domain. Recurring vulnerability scans run only for eligible paid accounts and only when the domain is due under its configured schedule. Authorized checks may cover the main domain and its publicly discoverable subdomains while proof remains current.

Scan limits attach to the account and may remain in our abuse and usage records after a domain or monitored address is removed. Deleting and re-adding a target does not create a new free scan or reset a limit. An account used to deliberately cycle targets, obtain repeated free scans, or continue scanning after a limit is imposed will be suspended or terminated.

You can connect an AI agent to your account through an API key. The agent acts for you: anything it does with the key is done by you, and it may only test domains on your account, using read-only checks. It may not log in to, attack or exploit any system. When the agent (or you) sends us verification results or scanner reports, you give us permission to store them and use them to correct your results and to improve DomainGuard for all customers. We do not publish your domains or the evidence you send.

9. Intellectual property

All content on this website, including text, graphics, logos, icons, images, and software, is the property of NHM LLC or its content suppliers and is protected by United States copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission. One exception: our verification method at /mcp/verify.md, and the verification steps the API returns, may be copied and used for any purpose, including commercial use, under the Creative Commons Attribution 4.0 licence.

10. Disclaimer of warranties

OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NHM LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OUR WEBSITE OR SERVICES.

12. Indemnification

You agree to indemnify, defend, and hold harmless NHM LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our website or services, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your account and access to our services without prior notice for conduct that we believe violates these Terms or is harmful to other users, us, a scan target, or a third party. Accounts used for malicious scanning, spam, deliberate limit circumvention, or repeated deletion and re-addition of targets to obtain free scans will be terminated. We may preserve records needed to investigate abuse, prevent repeat registration, respond to a target owner, or comply with law.

14. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Stark County, Ohio.

15. Changes to these terms

We may modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms. Our Privacy Policy describes how we handle personal information.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
