Terms of Service

These Terms of Service ("Terms") govern your use of services operated by NHM LLC ("NHM," "we," "us"), including the public website at nhmohio.com, the online dashboard and tools, our APIs and backend services (including those delivered via Cloudflare), and the Harbor mobile application ("Harbor") for iOS and Android. By accessing or using any of these services, you agree to these Terms.

1. Services overview

NHM provides managed IT and cybersecurity services to businesses, primarily in Northeast Ohio. Our digital properties include: informational and marketing pages; free security and IT tools; optional user accounts with a dashboard for domain monitoring, scans, alerts, status monitoring, and related features; programmatic access via API for eligible plans; and Harbor, a companion mobile app for account holders. Specific features depend on your plan and product configuration.

2. Mobile applications (Harbor)

Harbor is provided as a convenience for accessing your NHM account and monitoring data on a mobile device. When you download Harbor from the Apple App Store or Google Play, you also agree to the applicable store's terms and rules. We do not guarantee that every feature available on the website is available in the app, or vice versa; we describe core capabilities in the app listing and in-app screens.

3. Subscriptions and in-app purchases

Paid plans may be purchased on the website or, where offered, through in-app subscriptions processed by Apple or Google. Payment, renewal, cancellation, and refunds for in-app subscriptions are governed by the platform provider's terms and your account settings with that provider (e.g., Apple ID or Google Play). Pricing, trial terms, and plan limits may change; we will use reasonable means to communicate material changes. To the extent of any conflict between these Terms and the platform provider's mandatory terms for in-app purchases, the platform terms control for payment and billing disputes solely as required by those platforms.

4. Third-party services and integrations

Our services may interoperate with third parties you configure (for example, Discord webhooks, email providers, or third-party status pages). Your use of those services is subject to the third party's terms. We are not responsible for outages or actions of third-party services.

5. Account terms

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials, including any two-factor authentication methods.
  • You must notify us immediately of any unauthorized use of your account.
  • You must be at least 18 years of age to create an account.
  • One person or entity may not maintain more than one account.

6. Acceptable use

When using our website and services, you agree not to:

  • Use our security scanning tools to scan domains or systems you do not own or have authorization to test
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use our services for any illegal purpose or in violation of any applicable laws
  • Interfere with or disrupt the integrity or performance of our services
  • Attempt to reverse engineer, decompile, or disassemble any portion of our services
  • Use automated tools to scrape, crawl, or extract data from our website beyond what is permitted by our robots.txt

7. Free tools and resources

Our free tools (Domain Checkup, IT Checkup, Password Checker, Downtime Calculator, Phishing Quiz, and Security Assessment) are provided "as is" for informational and educational purposes only. Results from these tools should not be considered a substitute for professional IT security assessments. We make no guarantees regarding the accuracy, completeness, or timeliness of scan results.

8. Dashboard, API, and enterprise features

The dashboard and related APIs provide domain monitoring, security scanning, compliance tooling, and other features described on our site or in-product. Enterprise or API access may require separate configuration (including API keys). Different tiers offer different limits and functionality. We may modify features, limits, or pricing with reasonable notice where practicable.

9. Intellectual property

All content on this website, including text, graphics, logos, icons, images, and software, is the property of NHM LLC or its content suppliers and is protected by United States copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

10. Disclaimer of warranties

OUR WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NHM LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OUR WEBSITE OR SERVICES.

12. Indemnification

You agree to indemnify, defend, and hold harmless NHM LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our website or services, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your account and access to our services at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

14. Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Stark County, Ohio.

15. Changes to these terms

We may modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms. Our Privacy Policy describes how we handle personal information.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
